Estimates only, not tax or legal advice. The enhanced federal deduction for donated food (IRC 170(e)(3)) is the lesser of cost plus half the gap to market value, or twice cost. It is capped at 15% of the business's taxable income for the year, with a five-year carryover. The food must be apparently wholesome and given to a qualifying nonprofit, and the owner's tax adviser makes the final call. Defaults: Trans-Jordan's published $42.00/ton rate, the 2023 U.S. average of about $57/ton (EREF), and $2.34/mile truck cost (ATRI 2025). Cost at 25% of market value is a rough stand-in; use the real cost when you have it.
